Former fire chief sues city

Vernon’s former fire chief is suing the city for wrongful dismissal. 

Keith Green filed the civil claim in Vancouver B.C. Supreme Court on Feb. 14.

Green was hired as fire chief in April 2011, and terminated in August 2018.

This followed what the claim refers to as a "work-related psychological disability" suffered in September 2016.

Green was unable to work, but, after exhausting banked sick time and getting long-term disability support from his insurer, he began a plan with WorkSafeBC in June 2018 to gradually return to work.

Two months later, he was fired, and the city hired David Lind as his replacement.

The city refused to comment on personnel matters, but in Green's claim cited his "inability to return to full-time work" as the reason for his termination. It has 21 days to file a response.

The suit alleges the city “did not offer to accommodate the plaintiff's disability and to co-operate with WorkSafeBC in an attempt at a gradual return to work.”

Green is seeking compensation in the form of lost salary and benefits, plus interest and costs.

The claim says Green’s contract required a full year’s notice if the city sought to lay him off without cause.

Green's salary as fire chief was $136,000 a year.
