Creep sheriff plea bargain

A former Kamloops sheriff who was charged with sending sexually explicit texts to a girl he thought was 14 years old has struck a plea deal with the Crown.

Kevin Johnston, 50, appeared in Kelowna court Monday and pleaded guilty to breach of trust of a public officer.

Johnston had planned to meet up with a 14-year-old girl he had met online in the summer of 2016, after exchanging explicit messages. The person he was texting was actually a member of the Creep Hunters vigilante group.

A video posted to Facebook on Aug. 27, 2016, shows one of the Creep Hunters confronting a man on the phone whom she addresses as Kevin. 

“I honestly thought you were older, even though you did say you were 14,” Kevin says in the video. “You did say you were 14. I will full-on say that I read that in the texts, that you said you were 14. But, honestly, I didn't believe that you were that age, just by the texts.”

Creep Hunters said many of the messages were sexual in nature and included naked photos and a picture of a man in a sheriff's uniform.

Johnston was originally charged with luring a child, making sexually explicit material available to a child, and arranging a sexual offence against a child. The Crown is expected to drop those charges after he is sentenced on the single breach of trust charge.

Both the Crown and defence said Johnston's actions were reckless, during proceedings in court on Monday.

Johnston apologized in court to the sheriff's service for embarrassing the institution.

Special prosecutor Brock Martland said Johnston used his status as a sheriff to facilitate an online sexual relationship.

The plea deal includes a joint submission by Crown and defence suggesting a one-year conditional sentence in which Johnston would live under house arrest for the first four months and be barred from having any contact with females under the age of 18. He would also be expected to perform 100 hours of community service.

A final sentencing decision is expected to be made by the judge on Nov. 6. Johnston remains out of custody on bail.
