3 years for boat crash

UPDATE: 15:55 p.m.

The driver of a speedboat involved in a fatal houseboat crash on Shuswap Lake has been sentenced to three years in prison.

Fifty-four-year-old Leon Reinbrecht was convicted on one count each of criminal negligence causing death and criminal negligence causing bodily harm following a trial last year.

B.C. Supreme Court Justice Sheri Donegan also handed Reinbrecht a five-year ban from operating a vessel after he is released.

Reinbrecht was behind the wheel of a speedboat on July 3, 2010 after a Canada Day fireworks display on Magna Bay.

Court heard he was driving recklessly before crashing into a houseboat piloted by Ken Brown, who was killed while eight others were injured.

Last month, Reinbrecht's lawyer Joe Doyle argued unsuccessfully that the convictions should be overturned because his client was denied his right to a speedy trial.

A man found guilty of criminal negligence in connection with a fatal houseboat crash on Shuswap Lake in 2010 is expected to hear his sentence this afternoon. A hearing resumes in Kamloops Supreme Court at 2 p.m., according to the court docket.

Last October, Leon Reinbrecht was found guilty of criminal negligence causing death and criminal negligence causing bodily harm from a crash that killed houseboat operator Ken Brown and injured at least five people in July 2010.

A lawyer for Reinbrecht had argued that delays caused by the Crown and the court meant the case did not get to trial for nearly five years.

However, Justice Sheri Donegan dismissed the application.

"The societal interest in the completion of this trial is high, so when I weigh and balance all these factors, I am satisfied Mr. Reinbrecht's right to a fair trial has not been infringed in this case," Donegan said at the time.

Donegan ruled Reinbrecht was speeding in his speedboat at night after post-Canada Day fireworks when he smashed into the slow-moving houseboat.

A witness to the scene told the trial Reinbrecht's boat was travelling at "killing speed."

Another witness testified Reinbrecht had been drinking beer before the crash.
