Trip and fall incident triggers legal action against Interior Health Authority and the South Okanagan General Hospital

Hospital sued for trip, fall

The South Okanagan General Hospital and Interior Health are being sued by a man claiming to have been injured while the hospital was under construction. 

On Oct. 3, 2019, Allen Charles Baker alleges he tripped over bolts in front of the main entrance into the hospital, striking his head against a bench while falling. 

Baker claims the bolts were assumed to be “left from a sign that had been removed," according to the lawsuit.

The suit was filed Thursday in Penticton, and Baker is seeking damages for pain, cost of care, suffering, and post traumatic stress.

Baker claims there were no signs or blockades around the half-inch tall bolts in an attempt to warn the public. 

He further claims that he continues to undergo medical care and deal with pain and discomfort due to his injuries. 

The facility was under renovation at the time. The lawsuit states that the following day the bolts were removed. 

Interior Health was not immediately available for comment.
