Prolific offender suing prison over food poisoning

Inmate sues prison over food

A South Okanagan prolific offender is suing the Okanagan Correctional Centre for an alleged food poisoning incident that took place while he was behind bars.

Andrew R. Hardenstine filed a civil claim against the prison Friday, asking for $14,000 for pain and suffering relating to what he describes as a food poisoning incident that made him feel ill for three to four days.

Hardenstine alleges that on Aug. 3 2019, he was given "bad food" for supper which caused him to vomit all night.

"I still had some of my food the next day and checked the best before date and it was out of date," Hardenstine wrote in his claim. "I then informed the officer on shift and showed him [the] food, and I was treated for food poisoning in health care."

BC Corrections was not immediately available for comment on the suit.

Hardenstine is currently awaiting trial on weapons and drug charges after police seized a "small arsenal" of firearms and drugs from his home in Penticton in late 2018.
