Cyclist sues city after crash

A Kelowna man is suing the City of Kelowna after getting into a bicycle crash on the Okanagan Rail Trail this summer.

Daniel Risler was riding his bike eastbound on the section of trail between Spall Road and Hardy Street on June 21, when he says an oncoming cyclist cut him off, causing a crash.

In a recently filed notice of civil claim, Risler says the crash was caused by the negligence of both the other rider and the city.

He claims that section of trail was designed improperly and that a lack of signage to keep people on the right side of the trail is negligent on the city's part.

Risler says he injured his shoulder, back and right side in the crash, which has left him with chronic pain, sleep disruption, stress, anxiety and nightmares. He says he's had to seek medical treatment for his injuries.

As a result, he's seeking damages from the other rider and the city for loss of income, loss of housekeeping and handyman capacity, and the cost of past and future care.

Neither the city nor the other rider has responded to Risler's suit, which was filed Tuesday.

None of the allegations has been proven in court.
