Assault heading to trial

A man accused of multiple assaults, one of which put a man in a coma, has elected for a trial by judge.

Thomas Kruger-Allen, 22, is currently on house arrest for an assault in 2017 near the Mule Nightclub. His lawyer, James Pennington, appeared briefly in Penticton court Wednesday on behalf of his client. 

Kruger-Allen is accused of aggravated assault, sexual assault and common assault following an incident on May 3 at Okanagan Lake Beach. Brad Eliason, 28, left the altercation with a fractured skull and spent weeks in a coma at Kelowna General Hospital. 

Four witnesses are expected to be called at trial. 

A date was set for his arraignment, Aug. 14, at which time he will enter pleas. A trial date has not been set.
