Same Sex Pension Benefits

Gays and the federal government began squaring off Thursday before Ontario's highest court over back payments of same-sex pension benefits.

Ottawa has already changed the law - in July 2000 - to give Canada Pension Plan equality to survivors of same-sex relationships. However, it limited retroactivity to Jan. 1, 1998. Gay plaintiffs, who already have one ruling in their favour under their belts, argue the payments should go back to April 1985.

That's when gays and lesbians were granted equality rights under the Charter of Rights of Freedoms.
