Bobbitt trial put off yet again
The man accused of beating and sexually assaulting a woman in a Penticton second hand store was ordered to stand trial in June.
But exactly when the trial for David Bobbitt will take place remains up in the air.
Justice Alison Beames chastised lawyers Monday for not fixing a date as yet.
“Why are we on our sixth fix date?” she asked defence lawyer James Pennington.
Pennington explained to the court that his client still needs to think about the matter.
Whereas Beames said something has to happen on the next date of Feb. 25, whether it is fixing a date or otherwise dealing with the matter.
Bobbitt, who appeared by video, faces charges including attempted murder, aggravated sexual assault, unlawful confinement or imprisonment and uttering threats.
On July 31, 2011, the Penticton man, then the operator of Dave’s Second Hand Store on Ellis Street, allegedly sexually assaulted the 22-year-old woman in the shop following a vicious beating. Her toddler was found unharmed nearby.
After a Canada-wide warrant was issued for his arrest, he was spotted by an orchardist in the Oliver area on Aug. 3.
The man recognized him and immediately contacted the RCMP leading to his arrest.
The young woman, who was badly injured in the attack, received the support of the entire community.
Family members who have been waiting for a trial date to be set, were in court on Monday.
