Trial begins in violent assault case
Warning graphic testimony.
A dramatic 911 call made the morning a woman was allegedly violently assaulted in Oliver, was played in a Penticton courtroom on Tuesday.
The tape as well as witness testimony was heard on the first day of the trial for Brian Douglas Louie.
Louie is facing charges of aggravated sexual assault and assault causing bodily harm stemming from the incident the morning after a house party in May, where part of a woman's labia was bitten off during a sexual act.
On the tape, the host of the Oliver party, where the alleged assault took place, can be heard saying, "my friend is being beat up really bad at my house, I don't know what to do, he's beating the s...out of her. You've got to help her, he's going to kill her."
As the friend gives a further description of where she lives, the complainant, unnamed because of a publication ban, can be heard in the background, yelling, sobbing and asking for help.
The friend said the woman was at her house for a party, when she left to pick up the man. Earlier in the night, people had not wanted the man to come, but that changed as the party ran later.
When the two came in around 2 or 3 a.m. they seemed sober, but he started drinking when he got there and continued to do so the whole time he was there. They were friendly with each other. There was just a little touching and one kiss, said the witness.
The host went to bed soon after their arrival and awoke to the sound of the woman screaming.
"I heard her saying come help me, over and over again," she said.
She got up and saw her friend standing by the stairway, and Louie sitting at a table in the kitchen with a beer. There was blood running down the woman's legs and on the floor by her feet.
The woman was saying, call 911, he bit me and seemed to be in pain and really upset. The host grabbed a phone and told Louie he better leave, because she was calling the cops. He then ran over to the woman, threw her down on the ground and started beating up on her, the witness testified.
"I could see his arms flying, his legs moving and her being hit," she said. "I had never seen anything like that."
The host's ex-boyfriend appeared on the scene and they went into the bathroom and locked the door. They were terrified as they continued to hear yelling and banging noises in the house, the witness said. When the noise stopped, she saw her friend at the bottom of the stairs, telling her Louie had left.
Other witnesses who were at the party, described blood covering furniture and the floor after the alleged assault.
Doctor Catherine Rublee, who attended to the woman at Penticton Regional Hospital, after she was initially seen at a hospital in Oliver, said the patient had a complex laceration to her left labia, as well as bruising, swelling on her face.
The trial is expected to continue on Wednesday, with the complainant taking the witness stand.
