Shooting trial in jeopardy

The Crown’s attempted murder case against a South Okanagan man could be jeopardized by the death of the victim last week.

Afshin Ighani is charged with attempted murder for allegedly shooting Thomas Szajko in April, prior to a region-wide manhunt that saw him captured following a kidnapping in Princeton.

Szajko recovered from the gunshot, but died Dec. 1 of a drug overdose at his home in Oliver.

Crown prosecutor John Swanson said Friday he would be taking the next week to examine his case to determine if there is enough evidence to proceed without the Crown’s key witness.

Swanson said he was counting on the testimony of Szajko, but has not made a decision to proceed or drop the charges either way.

The matter is due back in court on Dec. 18. Swanson said he will have made a decision by then.

Ighani also faces several other charges related to the police chase and kidnapping in Princeton.
