Guilty of child porn charges

A Penticton man was found guilty Monday of possession, importing and distributing child pornography.

Jesse Prince, 34, was convicted by Judge Kathleen Ker following a five-day trial in October and November.

“I reject Mr. Prince’s evidence completely, and find it to be completely fabricated,” she said.

Prince was arrested in Sept. 2010 when police raided his father’s home on Green Mountain Road, where he was living.

An undercover police officer in Saskatchewan had received childporn from a file sharing account eventually traced to the IP address of the home.

Police seized several computers and found hundreds of child porn images on a desktop computer and external hard drive in Prince’s bedroom.

During the trial, Prince tried to argue that the computer was common property of the home used by everyone in a common area. He said he moved the computer into his room just a few days before his arrest.

Judge Ker dismissed the explanation, stating it was unlikely someone would download, share and view child porn in a common area of the home. Experts also testified there was no sign anyone besides Prince used the computer.

She stated Prince’s explanation of the events was contradicted by himself under cross-examination and technical evidence of the Crown.

He will be sentenced at a later date.
