No bail for accused in sex assault case

A 41-year-old man accused of kidnapping and sexually assaulting his 19-year-old ex-girlfriend in the Penticton area will remain in custody.
Judge Gregory Koturbash made the decision during the man's bail hearing Monday in a Penticton courtroom.
Koturbash said he based his decision on the fact there is a substantial likelihood the accused, who is not identified because of a publication ban on identifying the victim, was at risk to re-offend.
The man who appeared by video did not show any emotion during the hearing. Family members of the victim were in court, but declined to comment.
The accused is facing charges including Attempting To Choke to Overcome Resistance, Kidnapping, Unlawful Confinement, Sexual Assault with a Weapon and Sexual Assault Causing Bodily Harm.
The incident took place in August when, according to the RCMP, the suspect apparently confined and sexually assaulted the girl at a remote location, then he consumed pills resulting in unconsciousness.
The victim was able to free herself and drive herself, and the still unconscious suspect, from the location and call police.
The suspect was taken to Penticton Regional Hospital.
Following the incident, the man had suicidal inclinations, according to his lawyer James Pennington. Since then he has remained in custody and was set to undergo a psychiatric assessment for a month.
