Bail hearing delayed in sex assault case
Sep 24, 2013 / 5:00 am
The bail hearing for a 42-year-old man accused of confining and sexually assaulting a 19-year-old Penticton teen was put off to a later date in court on Monday.
The hearing for the man, who is the teen's ex-boyfriend, is now set to take place in October. The man is not named because of a publication ban on identifying the victim.
He is facing charges including attempting to choke to overcome resistance, kidnapping, unlawful confinement, sexual assault with a weapon and sexual assault causing bodily harm,
The incident took place in August when, according to the RCMP, the suspect apparently confined and sexually assaulted the girl at a remote location, then consumed pills resulting in unconsciousness.
The victim was able to free herself and drive herself and the still unconscious suspect from the location and call the police.
The suspect was then taken to Penticton Regional Hospital.
Following the incident, the man had suicidal inclinations, according to his lawyer James Pennington. Since then he has remained in custody and was set to undergo psychiatric assessment for a month.
The mother of the victim said outside the Penticton courtroom on Monday that she was relieved the man has not yet been released.
She said her family has been scared since the incident took place. To the point, where they have considered moving.
"Right now, we are not financially able to move," she said. "But when it comes to October, we will consider moving. Even to a women's shelter if necessary."
The man's next court appearance by video is Oct. 28.
