911 call heard in Hyatt trial
A dramatic 911 call made on the night Ashlee Hyatt died was played in a Kelowna courtroom on Tuesday.
A teen calling Peachland where the incident took place, said “someone is stabbed ,she is lying here, she looks like she is in shock, she is not talking to any of us,” as screaming and sobbing could be heard in the background.
The recording was heard on the third day of the jury trial for the accused, who is not identified because she was a juvenile at the time of the offence. She allegedly stabbed to death Hyatt on June 2, 2010 at a house party on San Clemente Avenue.
In further testimony heard Tuesday the best friend of the accused, also a friend of Hyatt’s, said the call took place as she was holding her red cardigan to Hyatt’s neck where the wound was, as another teen held up her head.
The witness, also unidentified, because she was a juvenile at the time, said the partying began after school when a group of teens began drinking rye whisky while four-wheeling in the Glenrosa area.
The partying carried on when the teens ended up at one of the girl’s homes in Peachland.
Hyatt was there at the house when others arrived and the group moved to the deck of the home where they continued drinking.
“There were no problems,” said the witness. “We were all getting along, just drinking with no complications.”
The teen along with the girl who lived at the house and Hyatt were together, just prior to the witness texting a young man who recently died in a car accident, to come over.
As the name was mentioned the witness broke down in tears saying she was seeing him at the time, although it was not 'Facebook official'.
She was with him when she heard screaming and yelling from out on the deck. There she found Hyatt and the accused yelling at each other, with Hyatt telling the accused "she was a slut.'
The fight took place because the accused supposedly cheated on her boyfriend with another teen.
The group was kicked out of the house by a woman who was friends with the host teen’s mother.
Out on the street, the accused and Hyatt continued fighting, with another teen trying to break it up.
At the time Hyatt continued to accuse the other girl of being a slut, said the witness. She then saw the accused with a knife and soon after Hyatt holding her hand up to a wound on her neck and saying that bitch just stabbed me.
It was then she took off her cardigan and used it to stop the bleeding, while out of the corner of her eye she saw other teens get into a fight with the girl allegedly involved in the stabbing.
As she assisted her fallen friend, she saw the accused run away from the scene.
In earlier testimony Tuesday, the defence attorney suggested it was another teen witness who actually brought the knife to the road, after a group of girls taunted the accused for allegedly cheating on her boyfriend.
In addition the lawyer said that blood on the bottom of the witnesses’ shirt was Hyatt’s, according to DNA testing, showing she had been near Hyatt.
The witness denied that she had the knife or that she was near Hyatt, claiming she fought with the accused to take the knife away from her.
The murder trial is expected to continue on Wednesday.
