Snelson appeals conviction

Neil Snelson will be getting another day in court.

Defence lawyer, Wade Jenson has filed an appeal with the BC Court of Appeal asking that Snelson's manslaughter conviction be overturned.

On October 6, a jury found Snelson guilty of manslaughter in the October, 1993 death of Jennifer Cusworth.

He was subsequently sentenced to 15 years in prison less double credit for the two years he had already spent in jail awaiting trial.

Jenson says the appeal is on the conviction alone and not the sentence.

"Those (grounds for appeal) will be fleshed out in due course. A central issue will certainly be based upon evidence the jury heard that they shouldn't have," says Jenson.

He says those grounds include a lengthy video taped interrogation played for the jury.

Jenson, who represented Snelson at trial, filed the appeal last week.

He says he will not be handling the appeal. That, according to Jenson will be looked after by an attorney specializing in appeals.

No date has been set for the appeal, which will likely be heard in Vancouver.

If successful with the appeal, Snelson could be granted a new trial.
