No bail in serious assault

A man accused in a serious assault on Rutland's notorious Hein Road in September will remain in custody after he was denied bail Wednesday.

Clayton Zeleniski, 46, faces charges of assault causing bodily harm, two counts of assault with a weapon, and using a firearm to commit an offence.

On Sept. 26, police were notified of a man suffering from a gunshot wound at Kelowna General Hospital. An investigation led to the same-day arrest of Zeleniski and 46-year-old Troy Gallant.

While Gallant has been released on $40,000 bail and is under house arrest, Justice Gregory Koturbash denied Zeleniski bail.

Zeleniski has an extensive criminal record dating back to 1999, including assaults and breaches of conditions.

On Nov. 18, Justice Koturbash ordered a technical suitability report to determine if Zeleniski's residence was suitable for the use of an electronic monitoring device if he was released on bail.

While the home was found to be technically suitable for the monitoring device, the residence was found to not be ideal for someone on bail, as other residents there are known to police and some are subject to their own probation conditions.

Zeleniski will appear again in court Thursday to consult with his counsel.
