Chad Kroeger is being sued over his throat problem.
The Nickelback frontman had a cyst on his vocal cords removed in July, prompting the band to cancel their remainder of their world tour and the rocker to file a $13 million insurance claim for over 60 cancelled shows.
However, insurers Lloyd's of London are now taking legal action against the 'How You Remind Me' hitmaker, claiming the 41-year-old star knew about the condition when taking out the policy, but failed to disclose it, rendering the documents void.
The insurance company are suing to have the policy ruled invalid.
The group announced in August they were cancelling the shows, which had been due to take place from September 30.
They said in a statement: "Nickelback is forced to cancel all remaining dates for the 2015 No Fixed Address Tour due to an extended period of vocal rest ordered for lead singer Chad Kroeger. Kroeger, who was diagnosed with an intracordal cyst on his voice box in June, recently underwent surgery and must remain on vocal rest as ordered by doctors for the next six to nine months in order to fully recuperate.
"Kroeger will require an extended period of recovery in order to heal completely."
The rockers released their eighth studio album 'No Fixed Address' last November and had been scheduled to perform throughout Europe between September and December.
In the statement, the band added they hope to return to the stage soon, despite the fact they have made no plans to reschedule the dates, with refunds available to fans who had tickets to the shows.
They wrote: "Most of all, we are sorry to miss our fans out on the road this fall, but Chad's health, healing and full recovery are what is most important right now. With the proper amount of time, we hope to have him back stronger and better than ever before. We thank everyone for their support and understanding during this time and look forward to getting back out on the road and playing music for everyone again real soon."
