Bail in fatal hit and run

A Quebec man charged with hit and run in the death of a two-year-old boy was granted bail Friday with numerous conditions.

Rick Modi, 24, is not allowed to drive and is prohibited from being in Saint-Constant, the town south of Montreal where the toddler was struck. He also had to pay a bond of $5,000.

Crown prosecutor Erin Kavanagh said Modi will be under strict conditions while he awaits trial.

"We had a long conversation with the defence, during which they offered us certain guarantees in order to ensure we maintain public security as well as the public's confidence in the justice system," Kavanagh said.

Two-year-old Dominique Wenga was hit by a car May 27 in front of his parents' residence after somehow getting away from people who were looking after him in the backyard.

The driver allegedly took off without coming to the boy's aid. Weeks later, Modi was arrested a few metres from where the boy was struck.

Modi has pleaded not guilty. He faces a life sentence if convicted.

The case is expected to resume Sept. 6.
