Legal To Lane Split

Q: I have heard rumors and stories that it is legal to lane split with a motorcycle in the States. I got into a pretty heated argument with another fellow rider, I strong believer that lane splitting in Canada, any where, is illegal. Am I right or may I be wrong.

A: Lane splitting or riding your motorcycle between vehicles already on a roadway is not only illegal, it is dangerous for all road users. A motorcycle operator must obey the rules of the road and lane splitting is against the law. In order to pass another vehicle already present in the lane, a motorcyclist must pass in accordance with the B.C. Motor Vehicle Act. Riding between two vehicles on a multi laned roadway is not the legal way to pass a vehicle.

Due to this careless driving maneuver, this offence is driving without consideration for other road users. Careless driving would also include riding on one wheel only on a motorcycle.

Careless driving prohibited
Section 144 (1) of the Motor Vehicle Act indicates that a person must not drive a motor vehicle on a highway
(a) without due care and attention,
(b) without reasonable consideration for other persons using the highway, or
(c) at a speed that is excessive relative to the road, traffic, visibility or weather conditions.
(2) A person who contravenes subsection (1) (a) or (b) is liable on conviction to a fine of not less than $100 and, subject to this minimum fine, section 4 of the Offence Act applies.
