Day four of the Hyatt trial

A teen witness said she was confused and drunk when she told a police officer she had seen a young man with a knife, the night Ashlee Hyatt died .

Her testimony was heard on the fourth day of the Kelowna trial for the teen accused of stabbing to death Hyatt at a party in Peachland on June 2, 2010.

The accused is not identified because she was a juvenile at the time of the offence.

The testifying teen, also unidentified, was the only witness on a day cut short because of technical difficulties tied to some of the evidence.

During cross examination the defence claimed the witness said in her first statement  to a police officer that a boy who was dating the accused at the time had a knife; in addition she was heard on a 911 tape played earlier in the trial saying “who f…..stabbed her.”

The defence further suggested that during the preliminary inquiry, the witness said a boy who is a really aggressive and not a very nice person could have given the accused the knife.

"My suggestion," the lawyer stated, "is you are prepared to bend the truth when you want to and I call that being dumb as a fox."

As the questioning continued, the witness broke down in tears, saying she was drunk at the time, confused and is not a liar.

The defence also said the witness had a thing for a boy, allegedly kissed by the accused at the party, that could have resulted in jealous feelings that night.

The witness denied that was the case saying she was with the boy before that  night but was with the young man, who recently died in a car accident in Peachland, the night of the party.

She stated she wasn't jealous in any way, just hurt that the accused, who she has described as her best friend, would do that when she and the boy used to be together.

According to earlier testimony, the fight between the accused and Hyatt began after the accused allegedly made out with the boy in question.

Others at the party became annoyed saying she was cheating on her boyfriend. Hyatt in particular was angry, calling the accused a slut.

The trial is expected to continue on Thursday.
