Lawyer Formally Charged

A retired Kelowna lawyer has been formally charged in connection with a drinking and driving incident.

Howard Berge appeared in Penticton court Monday morning, where he was charged with dangerous operation of a motor vehicle, impaired driving and refusing to provide a breath sample.

Charges stem from an incident on Highway 97 near Summerland about a month ago.

RCMP say a vehicle left the scene after hitting a flashing light on top of a median.

Berge's vehicle was stopped a short time later.

This is not the first time Berge has run afoul of the law in regards to drinking and driving.

He was convicted in 1985, and was charged again four years ago. Berge was eventually convicted of the lesser charge of driving without due care and attention for the 2002 arrest.

He resigned as President of the BC Law Society as a result of the 2002 conviction.
