City sued over bike crash

A Penticton retiree is suing the city for a fall he took off his bicycle last summer.

In a lawsuit filed Monday in Penticton court, David Tambellini claims he was riding his bike on July 24, 2017 “when he hit a depression in the road at or near 702 and 708 Creekside Road, causing him to lose control of his bicycle and fall to the road.”

The lawsuit claims Tambellini suffered brain injury, loss of consciousness, fractured ribs, back and neck injury, facial fractures and scarring.

The lawsuit seeks damages for pain and suffering, loss of income, future costs of care and more. The claim alleges negligence by the city in failing to keep the roadway in safe condition.

The City of Penticton has not filed a response yet and none of the above claims have been proven in court.
