Lawsuit over sidewalk fall

A woman is suing the District of Summerland after tripping on a sidewalk lip and injuring herself last month.

In a notice of civil claim filed in Penticton court this week, Alma Potter alleges she was walking out of the Summerland Aquatic Centre on Aug. 16 around 12:30 p.m., when she tripped on a sidewalk on Kelly Avenue.

“At the point of intersection of the sidewalks, the westbound sidewalk has fractured and collapsed several inches below the level of the Kelly Ave. sidewalk, creating an uneven and hazardous lip,” the lawsuit reads.

The fall resulted in a fractured pelvis, dislocated and fractured knee and soft tissue damage. The lawsuit doesn’t disclose Potter’s age, but notes she is a “homemaker,” who lost “homemaking capacity” and enjoyment of life as a result of the injuries.

The claim is seeking damages, alleging negligence by the District of Summerland for failing to properly maintain the sidewalk.

The District of Summerland has not filed a response to the claim, and none of the allegations have been proven in court.
