Woman sues city over fall

A Penticton woman is suing the city for a tumble she took while jogging over the Andrew McCulloch trestle bridge.

In a lawsuit filed Wednesday in Penticton, local fitness trainer Brenda Fenske claims she was running over the bridge on Oct. 11, 2015 when she tripped on a bolt protruding from the trestle surface.

The fall resulted in a fractured and sprained left hand, soft tissue injury and abrasions. The civil claim states the injuries have continued to cause pain, wage loss and diminished housemaking capacity.

Fenske alleges negligence, for failing to to keep the bridge safe or “give the plaintiff or any other persons any or adequate warning of the danger posed by the protruding bolts on the premises.”

The claim seeks general and special damages, past and future costs of healthcare and legal costs.

The City of Penticton has not filed a response to the lawsuit, none of the allegations have been proven in court.
